I have seen so many websites claiming that their photos are in “the public domain.” I am sure most of these site owners are simply unaware of what public domain or copyright infringement means, and honestly believe that their content is public domain.
For everyone that does not know what public domain is, and what photos are in the public domain – here it is: “Public Domain” means that the work may be used by anyone for commercial purposes and is not under copyright protection.
What Works are in the Public Domain?
A work becomes ‘public domain’ when…
It is published by the federal government of the United States
Its copyright owner legally gives up their copyright to the material
The producer of the material has been dead at least 70 years
How This Pertains to the Adult Industry
Well, most likely the Federal Government of the US did not produce the dirty pics webmasters are claiming to be in public domain, and I doubt a copyright owner of a work that is valuable would simply give up their copyright to the work and allow anyone to use it however they wish.
So that leaves only pics that were taken by photographers who have now been dead for 70 years or more to the public domain. If your photos are not black and white the photographer has not been dead for 70 years. As you can see- public domain for the adult entertainment industry really does not exist.
If you are using so-called “public domain” material, get it off your site and get licensed content! If you simply do not want to spend any money on content you can find sponsors and providers giving it away for free all over the Internet – and it come with a license!
