From the Trenches: Copyright Infringement Blues

Two months from today I will be in Houston for www.questparty.com and Lone Star Pornutopia III. What a way to end 2009! I’m writing this month’s column on a Sunday night. Even though the Chargers were on an off-week (not necessarily their level of play, just the NFL scheduling – though some folks think the level of play has been way “off” lately) this football city of San Diego rocked again this weekend with fans of high school, college, and professional football. The number of female football enthusiasts here is amazing, and they certainly know their football; and, they know how to cheerlead and look sexy, too.

Ironically, later tonight I plan to read the AARP Bulletin publication, which came in yesterday’s mail, the front page of which carries an article on ways to cope with funeral sticker shock. Maybe I should send a copy of it to the Chargers! Actually, I don’t intend to be around to handle any of my funeral matters, but maybe I should leave the article with all the stuff I’ve prepared for my daughter and son when that day comes.

Remember Melissa Ashley? She was the cute slender porn starlet whose first sex scene was with me, and she’s also in “Sugardaddy 19.” We did two separate scenes that morning 10 years ago, with the second sex scene appearing in “Sex Fun 4.” Besides the video, she and I also posed together for 20-25 hardcore photos. Some of those photos are on my www.davecummings.tv and www.davecummings.com sites, and apparently some folks have downloaded some of them.

Twice in the past, once in Hawaii and once in England, Melissa testified in trials prosecuting men for having child porn on their computers. Since she was over 20 years old during that shoot, the judges in both cases dismissed those charges. I was scheduled to testify in Virginia next month as an expert witness in a third case, but now that the prosecutor has received copies of the DOB documentation I faxed to the charged individual’s attorney, those charges have been dropped. I’m surprised that some prosecutors seem so sloppy in thoroughly checking the facts before filing criminal charges.

Finding interesting items to include in my recent columns has been a challenge now that the illegal tube sites are allowing (I wonder if some/any of them sort of facilitate it?) the posting/uploading of copyrighted adult videos for free downloading by massive numbers of people. As a result, porn shoots seem relatively few and far between, causing loss of income, jobs, etc by those involved in any and all facets of supplying adult entertainment. Why should companies spend money shooting porn and/or running adult websites when their content will be stolen, significantly curbing their earnings?

When work/shoots evaporate or cut back, there’s less to report in columns like this one. I wish the government would step in and go after the copyright thieves, just like a present case oversees involving criminal charges, not merely civil law suits. In that case, the uploaders and downloaders being charged might possibly end up in jail.

Besides the courts as a long term assist, we can only hope that technology quickly comes up with a way to protect copyrighted porn. In the meantime, though cam performances and gentlemen’s clubs are coping, content producers are significantly suffering. We need either a “bail-out” or government intervention; just because it’s “only” porn is not an acceptable excuse for not enforcing the copyright laws.
