ASACP Comments on SCOTUS Ruling in Texas Age Verification Case

ASACP Spotlights Study Finding Parental Controls ‘Underutilized’The Association of Sites Advocating Child Protection (ASACP) is reporting that the United States Supreme Court (SCOTUS) has issued its long-anticipated ruling in the case of Free Speech Coalition vs. Paxton.

The Court upheld Texas’s HB 1181 in a 6–3 decision, paving the way for more state-level age verification mandates nationwide.

This case is significant as it serves as the current cornerstone for the future of online child protection and freedom of speech in the United States and beyond. The SCOTUS decision in Paxton hinged on balancing two key constitutional concerns: Americans’ First Amendment rights and the state’s compelling interest in child protection.

The Free Speech Coalition argued that Texas’s HB 1181 imposes an unconstitutional burden on adults seeking access to legal adult-oriented content, violating viewers’ free speech protections. While the Courts have historically ruled against overly broad or burdensome restrictions on speech, mainly when less restrictive alternatives (e.g., parental controls and education initiatives) exist, Texas argued that age verification is a necessary measure to protect minors from harmful exposure to adult content.

ASACP’s Executive Director, Tim Henning, was among the first to comment on the high Court’s decision, helping clarify the situation for the association and the broader community of industry professionals and other stakeholders who may be impacted.

“Responsible industry professionals have long been proactive in preventing minors from accessing age-restricted materials online,” Henning stated. “From age-gates to intentionally excluding youth-oriented marketing and venues, these producers and publishers have been at the forefront of online child safety for several decades now.”

Henning underscored the proactivity of industry professionals in protecting the innocence of youth while supporting the rights of consenting adults.

“For example, billions of webpages and app instances are now protected by ASACP’s free-to-use RTA (Restricted To Adults) meta-labeling system, which prevents children from accessing adult-oriented materials,” Henning explained. “This powerful tool was developed by the association 20 years ago in response to the U.S. Congress’ demand that ‘something be done’ about kids’ easy access to online porn. Its widespread use demonstrates how the availability of effective tools for parental control underpins voluntary age assurance and gating.”

“By opening the door to more aggressive AV mandates, the Court has shifted the burden of online child protection away from parents and professional publishers and onto the backs of bureaucrats and ideologues,” Henning concluded. “ASACP will closely monitor the Court’s decision and the fallout it brings to the industry, as we move onto the next phase of online child protection.”
