Pink Visual Files Lawsuit Against Tube Site Operators |
 |
 |
www.ynot.com
On a scale of 1 - 10 how much do you want Pink Visual to win this lawsuit? About an 11 for me.
Could this set a precedent that makes the tubesites tumble like dominoes and make paysite owners much more profitable?

Wishful thinking is always a good thing, but it has to start somewhere....
On a scale of 1 - 10, I'm about a 15 on this one..

Hell yes...
But this approach hasn't worked so well for the RIAA. And last I checked, despite some high-profile judgments torrent sites are still readily available. It all starts with a population out there that now expects to get all this shit for free. I wish there was an answer for this, but it seems that nobody has come up with one yet...

A consortium of groups (EFF, FSC etc), lawyers, site owners, content producers, writers, inventors, poets, musicians, composers all putting pressure on congress to toughen up laws regarding Trademarks, Copyrite, anti-piracy etc. Sounds stupid, I know.
But its not. If it was pointed out to congress the gazillions of dollars that are being ripped off based on sales, which translates to taxes (in some cases, brick and mortar, income etc) they would get financial boners.
If it seems like evenutally theft will actually stifle creativity, as in many people won't see the point in creating something if they can not make even a few bucks off of it, it will get their attention.
Political pressure tied to international trade, tariffs, loans etc. Submit drafts/bills to United Nations encouraging member nations to force local laws, or to create them in their respective countries.
At the same time, start suing the hell out of anyone and everyone that owns tube sites. Go from the same angle/laws that a pawn shop owner has to abide by. Reciept of stolen property. If they have a serious and legitmate threat of being heavily fined and/or incarcerated, they will stop, or rat out whomever is posting stolen content.
Of course this is difficult to do on the 'porn' end of things as many in the public eye pretend they despise that genre of entertainment. At the same time, porn has usually been on the leading edge of new technology (cams, online billing, etc). Obviously the best way would be to involve Hollywood and other quarters of news agencies, print, etc.
Will that be easy and happen overnight? Of course not. But eventually people will see that, on a global scale, no one will ever own their own content, nor profit from it without some type of laws that have some backbone to it.
Ok, just a thought. I'm out of here. Need to go see if my boyfriend Mass-Dad needs me for anything.

I find this lawsuit most troubling as the owner of the tubes sued is also a producer of content. Predatory Cannibalism comes to mind. Using the stolen content of other content producers to create sales for themselves.
Also in general, some of these tube sites are owned by content producers that also operate affiliate programs. They are taking the money that affiliates earn for them and using it to operate these tube sites for the purpose of bypassing the payment of affiliate commissions on their tube site's sales.
Business as usual -- I don't think so ...
| Quote: | NEW YORK -- Pink Visual’s holding company has filed suit against the owners of Brazzers, alleging that four company-owned tube sites poached content from 45 copyrighted movies and have streamed them “tens of millions of times.”
The websites at issue in Pink Visual’s $6.75 million complaint include KeezMovies.com, PornHub.com, ExtremeTube.com and Tube8.com, all owned by Canadian companies Mansef Inc. and Interhub, whose officers operate both companies. ...
